1. About these terms
These Terms of Service explain the conditions for using fablehue.com and purchasing from FableHue ("we", "us", or "our"). Please read them before ordering. Our store uses Shopify to provide ecommerce services; purchases from this store are made with FableHue.
Our Shipping Policy and Returns, Refunds & Exchanges Policy form part of these terms. Our Privacy Policy explains how personal information is handled. Nothing in these terms excludes rights or remedies that applicable consumer law does not allow us to exclude.
2. Using our store
You must be legally able to enter into a purchase agreement, or use the store with the involvement of a parent or legal guardian who can do so. Provide accurate contact, billing and shipping information, and keep any account credentials secure. Do not use the website for fraud, unlawful activity, infringement, malicious uploads or attempts to interfere with the store or access another person's information.
3. Products and personalization
Review the product description, size, capacity, selected options, quantity, spelling, photo placement and delivery address before placing an order. Personalized products are made using the information and files submitted with your order. A preview helps you review the design, but screen colors, lighting and the printing process may cause minor differences in appearance. This does not remove your rights if an item is defective, incorrect or materially different from its description.
Use clear images suitable for the selected print area. If you notice an error or need to change or cancel an order, contact us promptly with your order number. We will check whether a change or cancellation is still possible. Changes or cancellations may not be possible once production or shipping has started. Your statutory rights remain unaffected.
4. Photos, text and other uploaded content
You retain ownership of content you upload. You confirm that you have the rights and permissions needed for us to reproduce that content on the products you order, including appropriate permission to use another person's image where required. Do not upload unlawful content or material that infringes another person's copyright, trademark, privacy or other rights.
You give FableHue and the service providers involved in fulfilling your order permission to store, process, resize, crop and reproduce your submitted content only as reasonably necessary to provide the customization service, produce and deliver your order, and resolve related support issues. This permission does not authorize us to use your personal photos in advertising. Personal information is handled under our Privacy Policy.
We may decline content or an order that we reasonably believe is unlawful or infringes rights. If we cannot fulfill a paid order, we will contact you and refund any payment for the unfulfilled items and associated charges.
5. Orders, prices and payments
Prices are displayed in US dollars unless another currency is expressly shown. Applicable shipping charges, taxes and the order total are shown at checkout. Review the final total before submitting payment. Available payment methods are displayed at checkout and are processed through the payment providers offered there.
An order confirmation acknowledges receipt of your order. Fulfillment remains subject to payment confirmation, availability and our ability to produce the requested customization. If a product is unavailable, payment cannot be verified, or a material pricing or listing error affects your order, we will contact you to explain the issue. We will not charge a higher price or substitute a materially different product without your agreement. If an order cannot be fulfilled, any payment for the unfulfilled portion will be refunded.
Prices and product offerings may change for future purchases. Changes do not retroactively change the agreed price of an accepted order.
6. Shipping and delivery
Our current shipping service covers the United States. Please review our Shipping Policy for rates, order cutoffs, production and handling times, transit estimates and tracking instructions. Estimated delivery dates are not guaranteed arrival dates unless we expressly state otherwise.
If a shipment is delayed, missing, damaged or marked delivered but cannot be found, contact us with your order number and tracking details so we can investigate and help resolve the issue. Do not send payment card details or passwords in a support message.
7. Returns, refunds and exchanges
Our Returns, Refunds & Exchanges Policy provides the full process. If an order arrives damaged, is misprinted because of our error, or contains the wrong item, contact us within 30 days of delivery. We cover return shipping for eligible issues caused by us. Contact us before mailing a return so we can provide instructions.
Because products are made to order, we do not accept change-of-mind returns or exchanges, or returns for customer-provided personalization errors or incorrect selections, when the product was made correctly according to the order, except where applicable law requires otherwise. After receiving and inspecting an eligible return, we process the refund within 5 business days; your bank or payment provider determines when it appears in your account. These policies do not limit mandatory consumer rights.
8. Website content and third-party services
FableHue's website design, branding and original content are protected by applicable intellectual property laws. You may browse and use the store for personal shopping, but may not commercially reproduce our protected content without permission or another lawful basis.
Links and services provided by third parties, including payment and shipping providers, may have their own terms and privacy policies. We remain responsible for our obligations to you as the seller. We work to keep the website accurate and available, but temporary outages or errors may occur. Contact us if an error affects your order.
9. Consumer rights and resolving concerns
Please contact us first if you have a concern about the store or an order so we can try to resolve it. Nothing in these terms limits liability that cannot lawfully be limited, or removes any non-waivable warranty, refund, dispute-resolution or other consumer protection available to you under applicable law.
10. Updates to these terms
We may update these terms by posting a revised version and updating the date above. Updated terms apply prospectively. The terms and policies in effect when you place an order govern that order, unless a change is required by law or you agree otherwise.
